Agoziem Art ("we", "us", "our") is the trading name of Chiagoziem Nneamaka Orji, a Nigerian visual artist based in Enugu, Nigeria. We operate agoziemart.com and sell original artwork, limited edition prints, and related products to customers within Nigeria. International customers are served through our partner store, ijele.store. These Terms apply to your use of agoziemart.com and any order placed through it.

By using this site, you confirm that you are at least 18 years of age, or have permission from a parent or legal guardian to make purchases.

• You agree to use agoziemart.com in a lawful manner and not to misuse the site or interfere with its operation.
• You are responsible for ensuring that information you provide is accurate and up to date.
• You are responsible for keeping your account credentials secure and for all activity carried out under your account.
• We may update, suspend, or discontinue parts of the site at any time to maintain quality and security.

We aim to describe products accurately, including size, materials, and edition details. However, colors may appear different depending on your screen. Handmade and limited pieces may have minor variations. Product images are for reference and may not capture every detail.

When you place an order, you are making an offer to purchase, not entering a binding contract. Order confirmation emails acknowledge receipt of your order but do not constitute acceptance. The contract is formed only when we dispatch the items.

We reserve the right to refuse, cancel, or limit any order for reasons including suspected fraud, errors in product information or pricing, stock availability, delivery limitations, or violation of these Terms. If we cancel an order after payment, we will refund the amount charged in full.

Pricing errors. If a pricing error is discovered after payment but before dispatch, we will contact you, cancel the affected order, and issue a full refund. We are not obliged to fulfill orders at incorrectly displayed prices.

• Prices are displayed in Nigerian Naira (NGN) and may change without notice.
• Payment is due at checkout and processed securely through Paystack, our payment partner. We do not store full card numbers on our servers.
• All applicable taxes are included in the displayed price unless otherwise noted at checkout.

We ship within Nigeria. Delivery time estimates depend on destination and carrier and are not guaranteed. Risk of loss passes to you upon delivery confirmation by the carrier. For full details, see our Shipping Policy.

International customers can shop our work through our partner store, ijele.store, which serves the United States with locally-produced canvas prints.

Return eligibility depends on the product type and the condition it arrives in. Some items may be non returnable, including custom or made to order pieces. For full details, see our Returns Policy.

All content on agoziemart.com — including artwork, illustrations, photography, text, graphics, branding, and the underlying digital files — is owned by or exclusively licensed to Agoziem Art (Chiagoziem Nneamaka Orji) and is protected by the Nigerian Copyright Act 2022 and international copyright, trademark, and intellectual property laws. The artist retains all moral rights in her work.

Purchasing artwork does not transfer copyright or any reproduction rights. A purchase grants you ownership of the physical or digital piece for personal display only. All reproduction, distribution, derivative, and licensing rights remain with Agoziem Art unless expressly transferred in a separate signed agreement.

Prohibited uses. Without prior express written permission from Agoziem Art, you may not:

• Download, copy, screenshot, save, or store images from this site for any purpose beyond ordinary browsing.
• Print, reproduce, or recreate any artwork in any format, size, or medium — including for personal, decorative, gift, or non-commercial use.
• Distribute, publicly display, perform, or share any artwork or content from this site.
• Create derivative works, adaptations, edits, modifications, or remixes based on any artwork.
• Use any artwork or content for commercial purposes, including merchandise, packaging, branding, advertising, publications, social media monetization, or paid services.
• Use any artwork, image, or content to train, fine-tune, evaluate, or develop artificial intelligence, machine learning, generative, or similar systems, models, or datasets.
• Mint, tokenize, or associate any artwork with non-fungible tokens (NFTs), cryptocurrency, blockchain, or similar digital asset systems.
• Remove, alter, obscure, or circumvent any watermark, signature, copyright notice, or rights management information.
• Scrape, crawl, harvest, or systematically extract content from this site by automated means.
• Resell, sublicense, or redistribute digital copies of any artwork.

Watermarks. Watermarks visible on artwork images on this site are intentional. Their presence does not authorize use of the artwork in any way.

Enforcement. Unauthorized reproduction, printing, or use of artwork constitutes copyright infringement and may result in civil and criminal liability under the Nigerian Copyright Act and applicable international laws. Agoziem Art reserves all rights to pursue legal remedies, including damages, injunctive relief, takedown of infringing material, and recovery of legal costs.

Licensing. To request licensing, reproduction rights, or commissioned work, contact us at [email protected].

Commissioned or custom work may require a separate written agreement covering scope, timelines, deposits, approvals, and usage rights. Unless otherwise stated, deposits for commissioned work may be non refundable once work begins. Copyright in commissioned work remains with Agoziem Art unless explicitly assigned in writing as part of the commission agreement.

If you submit reviews, images, or other content to the site, you confirm that you have the right to share it and that it does not infringe any third party rights. You grant us a non exclusive right to use that content for store operations, customer support, and marketing, unless you request removal where feasible. We may remove content that is unlawful, abusive, infringing, or misleading.

The website and products are provided on an "as is" basis to the extent permitted by law. We do not guarantee that the site will be uninterrupted or error free. Nothing in these Terms affects rights that cannot be excluded under applicable law.

To the extent permitted by law, Agoziem Art will not be liable for indirect, incidental, special, or consequential damages arising from your use of the site or purchase of products. Our total liability for any claim will not exceed the amount paid for the specific order giving rise to the claim.

We will not be liable for delays or failures to perform our obligations resulting from events beyond our reasonable control, including natural disasters, power or internet outages, pandemics, civil unrest, government action, courier or carrier delays, or supply chain disruptions. Where possible, we will keep affected customers informed and resume normal service as soon as reasonably practicable.

These Terms and any dispute arising from your use of agoziemart.com or purchases made through the store are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. The courts of Enugu State, Nigeria will have non-exclusive jurisdiction over any dispute, claim, or matter arising from these Terms.

This clause does not deprive you of mandatory consumer protections under Nigerian law that cannot be waived by contract, including rights under the Federal Competition and Consumer Protection Act.

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

No waiver. Our failure to enforce any provision is not a waiver of the right to enforce it later.

Entire agreement. These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and Agoziem Art regarding your use of agoziemart.com.

Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations to a successor entity without notice.

We may update these Terms from time to time. The "Last updated" date above indicates when changes were made. Continued use of the site after changes means you accept the updated Terms.
